Will they get away with it because they are the news media?

ATF form 4473, the document that federal law requires both the buyer and seller to complete, uses explicit language to determine if the buyer is purchasing the gun for herself, or on behalf of another person.
Question 11a ATF form 4473:
Are you the actual transferee/buyer of the firearm (s) listed on this form? Warning: You are not the actual buyer if you are acquiring the firearm (s) on behalf of another person. If you are not the actual buyer, the dealer cannot transfer the firearm(s) to you.
The “NOTICES, INSTRUCTIONS AND DEFINITIONS” section of ATF form 4473 lays out more guidance about personal ownership and transferring a firearm.
You may purchase a gun for yourself or you may purchase the gun as a gift. “However you may not transfer a firearm to any person you know or have a reasonable cause to believe is prohibited under 18 U.S.C 922(g), (n), or (x).”
SpecDive Tactical told TheDC in a statement dated Tuesday that it has “formally filed an accusation with the Bureau of Alcohol, Tobacco, Firearms and Explosives and Virginia State Police today against CBS News and more specifically Ms. Paula Reid, whom SDT believes purchased a firearm under false pretenses for her employer, CBS News.”
Time will tell.

They probably will get away with it.  It is not uncommon for the media to break the law to make the news.  Notice that I stated "make" the news and not "report" the news.  Why not! Our Government does it all the time - break laws and then tout themselves as heroes by never letting a crisis (that they made) go to waste.  Remember that Ruby Ridge was started by an illegal sale of a sawed-off shotgun, which was sold by an undercover agent.
What most 21st Century Americans simply do not grasp is that the Constitution and Bill of Rights were not written to to give rights to the citizens of our then-new nation, but was instead written to tightly constrain the federal government.

To defend one's self, or a nation, requires "layers" of defense. What is being attempted is to remove the inner layer of defense - the armed citizen - the citizen's militia.

If the enemy manages to infiltrate the outer defense, the inner defense must be able to repel or destroy the enemy. At the minimum, to repel the enemy where the outer defense can handle them.

The only time that you invite the enemy "into the house" is when it is assured that you can invite them "out of the house."

I highlighted a portion of the quote simply because the Constitution does not protect; it is simply words on paper with no meaning to many.  Ultimately, we protect ourselves with words of war or by war itself.  The Constitution is only as effective by those who condemn it unless they are thwarted by those who defend it.
